10-A-Day Pet Insurance Give Away Official Rules

1. Eligibility: The 10-A-Day Pet Insurance Give Away (the “Promotion”) is open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older, located in the U.S. at the time of entry and who own a dog or a cat. Employees, contractors, directors and officers of Merial Limited (“Sponsor”), Shepherd Agency (“Judging Agency”) and their respective parents, subsidiaries and affiliated companies, distributors, licensees and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of this Promotion (collectively, “Promotion Parties”), and their immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible. Void elsewhere and where prohibited by law.
2. Promotion Period: The Promotion begins at 12:00 a.m. Pacific Time ("PT") on June 20, 2011 and ends at 11:59 p.m. PT on August 19, 2011 (the "Promotion Period").
3. How to Enter:
Online Entry: During the Promotion Period, go to www.cesarsway.com/10adaygiveaway (“Website”) and click on the link to locate the official entry form. Follow the on-screen directions, complete all required registration fields (“Online Entry”). LIMIT ONE (1) ONLINE ENTRY PER PERSON/E-MAIL ADDRESS/DAY.
4. Daily Drawing: On or about a week after each day of the sweepstakes, a random drawing for each daily prize pool will be conducted from among all eligible entries received for each day of the sweepstakes during the Promotion Period. Entries received for previous Daily Prize drawings will roll-over into subsequent Daily Prize drawings.
5. Prizes, Approximate Retail Value (“ARV”) & Odds: Six Hundred (600) First Prizes (ten per day): a one (1) year VPI® Medical 100 Plan policy in addition to a “CareGuard® Core” wellness rider for one (1) dog or cat owned by the first prize winner, subject to verification. The prize consists solely of the premium for the one (1) year policy and rider. Prize is an insurance policy and all applicable deductibles, co-payments, fees or other charges related to use of the policy are each first prize winner’s sole responsibility. (ARV: $425). Total ARV of all Daily Drawing prizes is $255,000. The actual retail value of the prize may vary depending on multiple factors, including, without limitation, winner’s state of residence and age of the dog or cat. Sponsor and Judging Agency are not responsible for and first prize winner will not receive the difference, if any, between the actual value of the prize at the time of award and the stated ARV in these Official Rules or in any Sweepstakes-related correspondence or materials. First prize winners agree that they must comply with Sponsor’s and Veterinary Pet Insurance Company’s (“VPI’s”) procedures and policies and the terms and conditions of the prize policy, or prize may be forfeited in Sponsor’s sole discretion. Once the dog or cat is selected and approved for coverage under the prize policy, the dog or cat may not be changed or substituted without Sponsor’s and VPI’s approval. Some first prize winners may not qualify or meet eligibility requirements to receive a pet insurance policy for their cat or dog. It is each first prize winner’s sole responsibility to comply with all application and enrollment requirements of VPI, which may include, without limitation, providing additional information and documentation concerning the pet’s medical history and reading and signing additional documentation. Eligibility for issuance of a pet insurance policy is subject to VPI’s underwriting approval. Only a newly-enrolled dog or cat that is not currently covered by an insurance policy with VPI will be eligible for a First Prize. Sponsor reserves the right to award an alternative cash prize to a First Prize winner in the amount of $425.00 if that winner is determined to be ineligible by VPI, or if the winner’s eligible dogs and cats are already insured with a VPI policy. Plan type and benefits are subject to state availability. Pre-existing conditions are not covered. Pre-existing conditions mean any conditions that began or contracted, manifested or incurred before the effective date of the policy, whether or not the condition was discovered, diagnosed or treated. No substitution, cash redemption is permitted except at Sponsor’s sole discretion. If prize is unavailable, Sponsor may substitute a prize of equal or greater value. Winner may transfer prize, but such transfer is subject to pre-existing conditions and underwriter approval, as outlined above. All federal, state and local taxes, and all other costs associated with acceptance or use of the prizes, are the sole responsibility of the winner. Arrangements for delivery of prizes will be performed after winner validation. LIMIT ONE (1) PRIZE PER PERSON, EMAIL ADDRESS or HOUSEHOLD. Odds of winning any prize depend on the number of entries received. Unclaimed prizes may not be awarded. If a winner does not use the entire prize, the unused portion will be forfeited.
6. General Rules: All federal, state and local laws apply. Winners will be notified by email, mail or telephone. Potential winners and the associated registered colleagues may be required to sign and return an Affidavit of Eligibility and Release of Liability, a Publicity Release and any tax forms requested by Sponsor or the Judging Agency within ten (10) days of attempted delivery or prize will be forfeited. The return of any prize/prize notification as undeliverable or failure to respond to notices or to return any documents in a timely manner, as determined by the Judging Agency, may result in disqualification and an alternate winner may be chosen. When the winner documents are received by Sponsor or the Judging Agency and determined to be in full compliance with all requirements, the winner will be sent a prize packet with information about the prize provider’s pet insurance products and the necessary steps to start the enrollment process. Winners must contact the prize provider within thirty (30) days of Sponsor mailing the prize packet or the prize may be forfeited. By participating, participants agree to release, discharge and hold harmless Promotion Parties from and against any and all liability or damages associated with this Promotion or acceptance, use or misuse of any prize received in this Promotion. Promotion Parties are not responsible for any typographical or other error in the printing of the offer or administration of the Promotion. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and likenesses for purposes of advertising and publicity without further compensation, unless prohibited by law. By participating in this Promotion, participants agree to be bound by the Official Rules and decisions of the independent Judging Agency, which shall be final in all matters relating to the Promotion. Promotion Parties are not responsible for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage-due mail; or for printing, distribution or production errors or for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Promotion, or by any human, or other error, which may occur in this Promotion. If, in the Judging Agency's sole opinion, there is any suspected or actual evidence of tampering with any portion of the Promotion or if technical difficulties compromise the integrity of the Promotion, the Judging Agency reserves the right to void suspect entries and/or modify and/or terminate the Promotion and/or conduct a random drawing to award the prizes using all known eligible non-suspect entries received. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the person's name submitted at time of entry. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or Website or acts in a disruptive manner. This Promotion is offered only in the United States and is governed by the laws of the State of Georgia. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Georgia located in the county of Gwinnett for any action, suit or proceeding arising out of or relating to this Promotion.
7. Waiver: By participating in this Promotion, participant waives all rights to claim punitive, incidental and consequential damages, attorneys’ fees or any damages other than actual out-of-pocket costs incurred to participate.
